These Terms and Conditions govern your access to and use of ceard.com, the Ceàrd mobile application, and all related services (collectively, the Service). By accessing or using the Service, you agree to be legally bound by these Terms.

1. Eligibility
You must be at least 13 years of age to use the Service. If you are under the age of 18, you represent that you have permission from a parent or legal guardian.

2. Account Registration
• You agree to provide accurate, complete information during registration
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities occurring under your account
• Ceàrd may suspend or terminate accounts that violate these Terms

3. User Content
Ownership
You retain ownership of all content you create and upload to the Service.

License
By submitting content to the Service, you grant Ceàrd a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and promote your content within the Service and in connection with Ceàrd marketing and promotional activities.

Restrictions
You agree not to upload content that:
• Is unlawful, abusive, defamatory, or infringing
• Contains malware or harmful code
• Violates third-party privacy or intellectual property rights
• Contains spam, advertising, or fraudulent activity

4. Prohibited Conduct
You agree not to:
• Interfere with the operation of the Service
• Attempt unauthorized access to systems or accounts
• Scrape, harvest, or collect user data without permission
• Use the Service for commercial activities unless expressly permitted

5. Subscriptions and Payments
• Subscription fees are stated within the app or on the website
• Payments are processed by third party providers including Stripe, Apple, and Google
• All charges are final unless otherwise required by applicable law
• Taxes and additional fees may apply

6. Intellectual Property
All Ceàrd trademarks, logos, designs, and proprietary technology are the exclusive property of Ceàrd, Inc. You may not copy, distribute, or modify any part of the Service without written permission.

7. Disclaimers
The Service is provided on an “as is” and “as available” basis. Ceàrd makes no warranties, expressed or implied, regarding:
• Accuracy or reliability of the Service
• Availability of the Service
• Security or error-free operation

8. Limitation of Liability
To the fullest extent permitted by law, Ceàrd shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

9. Termination
Ceàrd may suspend or terminate your access to the Service at any time for violating these Terms or for any conduct deemed harmful to the platform.

10. Modifications
Ceàrd may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

11. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
